You must be at least 16 years old to create an account. See our Privacy Policy for how we handle your data.

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Anti-Abuse-System (AAS)

To maintain a fair and secure environment on our platform, we have implemented the Anti-Abuse System (AAS). AAS monitors user activities to ensure compliance with our Terms of Service. Any violations detected by AAS may result in warnings, suspensions, or termination of user accounts, depending on the severity of the offense.

Free-Server-Service

1. Subject and Scope

The following regulations apply to participation in the free server service. By registering and participating in the service, the user accepts these regulations.

2. Restriction to Single Usage by Person

The registered user is only allowed to have one active participation in the free server service at any given time. This restriction applies to the individual person, not just per account.

Multiple participations by the same person, even through the use of multiple accounts, are not allowed. We reserve the right to determine whether the usage is by a single individual, utilizing state-of-the-art technology to enforce this rule.

3. Discord-Integration

A "Discord integration" is necessary for making use of the Free-Server-Service. This function is implemented to confirm the user's identity. If the verification through the "Discord integration" is terminated, all previously installed "Free Servers" may be deleted.

4. Consequences of a violation

If we recognize that a user violates the regulation according to section 2, we reserve the right to delete or shut down all accounts of the user in question at our own discretion in order to ensure compliance with the regulation.

5. Advance notice and possibility of objection

The relevant user will be notified by email about the next steps related to their violation. This notification will be sent at least 14 days before the action is carried out. During this period, the user is obliged to contact the support team independently and to discuss the problem, otherwise the measure will be carried out as described.

Our Service may contain links to third-party web sites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Where the Free-Server-Service rules above provide for advance notice, those rules take precedence for the case they cover.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Upon termination, your right to use the Service will immediately cease. In the case of termination, all services connected to the account will also be terminated.

If you wish to terminate your account yourself, use the delete function in your account area (see First Steps). Simply stopping to use the Service does not delete your account — it will be locked for inactivity instead.

Backup

We do not create backups for your server, and are not responsible for backing up your data.

By using our service, you acknowledge that you are responsible for creating backups and that we are in no way responsible for any data loss.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Legal

You expressly assure us that the provision and publication of the content created by you or third parties does not violate any applicable law, including the law applicable to this Service and the law of your country of residence, in particular copyright, data protection and competition law.

We reserve the right to remove any content from your server that appears to be of questionable content without prior notice. The same applies if we are requested by third parties to change or delete content due to the violation of third-party rights.

If our services and servers are used to conduct unlawful activities, we will immediately terminate our services to you. We also reserve the right to take legal action against you.

We are liable for damages caused by us only in case of gross negligence or intent. Otherwise, liability is excluded. We are not liable for (business) damages caused by a technical failure or downtime of your server. Of course we will do everything to limit technical failures and downtimes as much as possible.

You indemnify us from all possible claims of third parties resulting from an illegal action on your part or from errors in the information provided by you. This applies in particular to violations of copyright, data protection and competition law.

Advertising

The promotion or advertisement of companies, products, or services on the platform and its associated services is strictly prohibited. This includes, but is not limited to, advertising through server names, descriptions, chat messages, or any other means provided by the Service.

Violations may result in immediate suspension or termination of your account without prior notice.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany. If you use the Service as a consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country in which you have your habitual residence.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
